1. Information prior to the contractual process

This website www.jebandrews.foundation is the property of FUNDACION JEB ANDREWS FOUNDATION with CIF G66465451 and fiscal address at C/ CRISTOFOL MESTRES 74 08810, SANT PERE DE RIBES (BARCELONA).

The General Conditions of Contract regulate the distance selling relationship between FUNDACION JEB ANDREWS FOUNDATION and the user or customer, in accordance with the legal stipulations, in particular, Law 7/1998, of April 13, on General Conditions of Contract, Law 3/2014, of 27 March, which amends the revised text of the General Law for the Defense of Consumers and Users, the Organic Law 15/1999, of 13 December, on the Protection of Personal Data, Law 7/1996, of 15 January, on the Regulation of Retail Trade, and Law 34/2002 of 11 July, on Services of the Information Society and Electronic Commerce.

JEB ANDREWS FOUNDATION reserves the right to make any changes it deems appropriate, without prior notice in the General Conditions whose application will only bind the user if he/she formalizes the contract in force at that time. Therefore, the amendments will not be applied retroactively. Such modifications may be made through its websites by any legally admissible means and shall be binding for as long as they are published on the website and until they are not validly modified by subsequent modifications. However, the JEB ANDREWS FOUNDATION reserves the right to apply in certain cases some Special Conditions of Contract in preference to these General Conditions when it deems appropriate, announcing them in a timely manner.

2. Object of the General Conditions of the Contribution.

The purpose of the website is to help children with cancer and their families by raising funds through donations, CD sales, downloads and streaming.
The website contains the possibility of making monetary contributions online through the PAYPAL platform, by credit card or by bank transfer. Likewise, in the case of making financial donations JEB ANDREWS FOUNDATION FUNDACION JEB ANDREWS FOUNDATION, will provide the user with the corresponding receipt in order for the user to carry out the appropriate procedures.
As user or User expressly declares to know, understand and accept the conditions of use and these general contracting conditions. Likewise, he/she declares to be of legal age and to have the necessary legal capacity to access the websites of the JEB ANDREWS FOUNDATION and to contract through them.

Types of cash contributions

Through the website it will be possible to make monetary contributions that will go entirely to the Jeb Andrews Foundation. Users may make their contributions by choosing from the following options available on the website:

Donations: the user will be able to donate to the JEB ANDREWS FOUNDATION the following amounts: 10€, 50€, 100€, 200€. To make a donation, please go to the section I WANT TO CONTRIBUTE.
Purchase or download the album. The CD or download of the album J.A. FOUNDATION will be available to the Users, and whose access is located in the section I WANT TO COLLABORATE. The article includes a photograph and the essential characteristics of the article, this is the information obtained from the article itself. The color of the item(s), observable in the photograph is not binding. It is identified in the characteristics.

4. Financial contribution

Donations: The donation will become effective at the time the transaction is finalized. The user will be informed through the website of the confirmation of the donation. Also, if the user wishes, he/she may request that a confirmation e-mail be sent to him/her together with the necessary proof for the tax deduction. The user, in the case of a legal entity, may choose to receive an invoice for the donation made.
Purchase and download the J.A. FOUNDATION album. The purchase of the item(s), together with the corresponding economic transaction will give rise to the effective monetary contribution, the delivery of the item(s) being a symbolic transaction. Said financial contribution shall be used for the purposes set forth in the object of these general conditions. The user, in the case of a legal entity, may choose to receive an invoice for the purchase or download made. Likewise, JEB ANDREWS FOUNDATION, undertakes to ship the purchased item in due time and form as set forth in section 7.Delivery and transportation costs.

Warranties

All items offered on the website are guaranteed by the JEB ANDREWS FOUNDATION. In the event of any type of error or defect in the download or purchased material, an after-sales service is available, while the warranty is in force, the customer may execute it by contacting the JEB ANDREWS FOUNDATION, the after-sales service, by e-mail at hello@jebandrews.foundation or at the points established by the supplier itself. Preliminary procedure and form of payment

Depending on the type of monetary contribution you choose, you should take into account:

Digital download: To make a digital download, please go to the section available on the website. The method of acquiring the digital download is through the platform.

Paypal

Allows you to send payments on the Internet securely and conveniently. The PayPal network builds on the existing financial infrastructure of bank accounts and credit cards to create a global real-time payment solution. Paypal offers a service specially designed for those who are not satisfied with traditional payment mechanisms.

Purchase of cd’s and donations. To purchase the CD or make a donation, you can go to the corresponding section of the website. The user will be able to choose between the following methods to be able to make the monetary contribution for the acquisition of articles:

Credit card VISA or MASTERCARD

All operations involving the transmission of personal or banking data are carried out using a secure environment, a server based on standard SSL (Secure Sockets Layer) security technology. All the information you transmit to us travels encrypted through the network.

Likewise, your credit card information is entered directly on the bank’s website, at the bank’s POS (Point of Sale Terminal) and is not entered or recorded on any server of the JEB ANDREWS FOUNDATION FOUNDATION.
When paying by VISA or MASTERCARD, you will always be asked for the following information: the card number, the expiration date, and a Validation Code that matches the last three digits of the number printed in italics on the back of your VISA or MASTERCARD, thus offering more guarantees about the security of the transaction.

This payment method is valid only on the web.

Bank Transfer

When selecting the bank transfer method, you must make a deposit or transfer in the name of JEB ANDREWS FOUNDATION to the “Banc Sabadell” account:

It is very important that when making the transfer you indicate in the subject line your name and surname, and make the transfer within 3 days from the date of the order or donation in order to validate it.
If you wish, you can send us the proof of the transfer by e-mail hello@jebandrews.foundation. But in any case, the order or donation will not be considered effective until our administration department does not have bank confirmation of the transfer.
We remind you that payment must be made in EUROS and that all possible exchange and bank fees are at your expense.

In the case of bank transfers made from outside Spain, it is very important that when ordering the transfer, you always inform your bank to take charge of the commissions at origin, those bank commissions and expenses corresponding to your entity. Otherwise, the JEB ANDREWS FOUNDATION may stop the shipment of your order if we do not receive the full amount of your order.
Any exchange and bank charges are to be borne by the customer.

When the amount of a donation or the purchase of an item(s) has been fraudulently or improperly charged using the number of a payment card, the cardholder may demand the immediate cancellation of the charge. In such a case, the corresponding debit and recredit entries in the supplier’s and holder’s accounts shall be made as soon as possible.

However, if the donation or the purchase of an item/s had actually been made by the cardholder and the cancellation of the corresponding charge has not been duly demanded, the cardholder shall be liable to the JEB ANDREWS FOUNDATION for any damages caused as a consequence of such cancellation.

Prices

All items indicate the selling price in Euros and include Value Added Tax (VAT).

If any other tax is applicable, this would be indicated.

Delivery and transportation costs

JEB ANDREWS FOUNDATION undertakes to deliver the order within a maximum of 15 days from the day following the order.

JEB ANDREWS FOUNDATION ships internationally.

Shipping costs will depend on the country to which the shipment is made:

Availability

The availability of items offered by the JEB ANDREWS FOUNDATION may vary depending on customer demand. Although the JEB ANDREWS FOUNDATION updates the stock periodically, the product requested by the customer may be out of stock at that moment. In case of non-execution due to unavailability, JEB ANDREWS FOUNDATION will notify the customer by e-mail as soon as it becomes aware of this situation.

The period of this communication shall in no case exceed a maximum period of 30 days. JEB ANDREWS FOUNDATION FOUNDATION will be able to give the double option of: supplying the customer without price increase, a product of similar characteristics or of superior quality, or except for justified and demonstrable reasons by JEB ANDREWS FOUNDATION FOUNDATION FOUNDATION within the same period, pay the sums paid for the cancelled order. In the event that the JEB ANDREWS FOUNDATION FOUNDATION does not make this payment within the specified period, the purchaser may claim double the amount due, without prejudice to his right to compensation.

Process for the user

It is not necessary to register as a user of the website to make a purchase and/or donation online. However, to make donations or purchase our products and / or goods you must fill out forms for this purpose, therefore, we inform you that in accordance with the provisions of Law 15/1999 on Protection of Personal Data, FUNDACION JEB ANDREWS FOUNDATION informs users that personal data collected during the registration process and subsequent purchase, will be entered into a file under its responsibility, in order to process such actions by the user and manage subsequent actions arising therefrom. Likewise, FUNDACION JEB ANDREWS FOUNDATION informs of the possibility of exercising the rights of access, rectification, cancellation and opposition by writing to the address C/ CRISTOFOL MESTRES 74 08810, SANT PERE DE RIBES (BARCELONA) or by e-mail to hello@jebandrews.foundation.

Unless you inform us otherwise, we will assume that your data has not been modified, that you agree to notify us of any change and that we have your consent to use it in order to maintain the relationship between the parties.

During the purchase process you must identify yourself with the user name and password provided. This data will not be made public. You are responsible for treating confidentially and responsibly the identity and password obtained in the registration as a customer, not being able to transfer them to another. You can modify the registered information at any time, in your customer area. In this same section you will have access to a history of your orders, this is only a consultation section but its management is allowed, and the user can delete those records that he/she considers it is not necessary to visualize.

Once the purchase process is completed, the customer will receive a confirmation of the purchase by e-mail. It is essential that during the purchase process the user indicates a valid email address. The customer, upon receipt of the product at the delivery address provided, will receive an invoice or copy of the order.

Final process

Donations. JEB ANDREWS FOUNDATION will provide a receipt for the user to make the necessary arrangements. The user will be informed of the final destination of the donation. In any case, if the user requests it, he/she will be informed by e-mail about the destination of the contribution.
Purchase or unloading of items. Once the purchase process has been completed, the user will receive a confirmation of the purchase by e-mail. It is essential that during the purchase process the user indicates a valid e-mail address. If within 24 hours from the completion of the order you do not receive the confirmation, please contact FUNDACION JEB ANDREWS FOUNDATION at the customer service telephone number 938964921 or by e-mail hello@jebandrews.foundation.
The User, upon receipt of the item(s) at the delivery address provided, will receive the order together with proof of order.

For special promotions and their validity

In the event that an item/s is/are on promotion, the price and validity of the promotion will always be indicated together with its essential characteristics.

In compliance with current regulations, the JEB ANDREWS FOUNDATION offers information on all items for sale, their characteristics and prices.

However, JEB ANDREWS FOUNDATION reserves the right to withdraw, replace or change the item(s) offered through its website by simply changing the content of the website. In this way, the item/s offered at any given time by the website will be governed by the General Terms and Conditions in force in each case. Likewise, the company shall have the right to stop offering, without prior notice and at any time, access to the item(s) mentioned.

JEB ANDREWS FOUNDATION Commitment

The JEB ANDREWS FOUNDATION guarantees that the contribution will be used to provide financial support to the families for travel expenses, lodging, per diem and medicines for cancer treatment, through various national and international oncology hospitals.

In turn, Jeb Andrews donates 100% of the profits from his music and performances to the foundation.

Right of withdrawal, returns and complaints

Withdrawal

According to the provisions of Article 103 of Law 3/2014, of March 27, which amends the revised text of the General Law for the Defense of Consumers and Users, supplies of services or goods made according to consumer specifications or clearly personalized, or which, by their nature, cannot be returned or may deteriorate or expire rapidly, are exempt from withdrawal.

Return of the defective product.

In the event that the item/s is/are not in good condition and the causes attributable to this, are not a consequence of the customer, the customer will be entitled to return the product, informing FUNDACION JEB ANDREWS FOUNDATION of the reason for return through any of the means provided in these conditions of contract, and at no cost to the customer. This return due to defect or poor condition of the product will not be considered a right of withdrawal.

The JEB ANDREWS FOUNDATION undertakes to assume the cost of the return and to replace the product with a new one in accordance with the conditions accepted at the time of sale.

Refund of payment

The reimbursement of the amounts received by the customer will be made using the same means of payment used by the customer, unless otherwise provided.

The JEB ANDREWS FOUNDATION may withhold the refund until it has received the product, reason for withdrawal, or until the customer provides proof of return of the product, depending on which condition is met first.

In case of unjustified delay on the part of the JEB ANDREWS FOUNDATION, with respect to the refund of the sums paid, the customer may claim double the sums paid, without prejudice to the right to be compensated for damages suffered in excess of that amount.

Jurisdiction

Also, FUNDACION JEB ANDREWS FOUNDATION reserves the right to file civil or criminal actions it deems appropriate for the misuse of its website and content or for breach of these conditions.

The relationship between the user and the provider shall be governed by the regulations in force and applicable in the Spanish territory. Should any controversy arise, the parties may submit their disputes to arbitration or resort to ordinary jurisdiction in compliance with the rules on jurisdiction and competence in this regard.
